General terms and conditions for the training and further education

Good to know

The provisions defined herein form an integral part of the above training agreement with Living Sense Executive GmbH (hereinafter referred to as Living Sense Executive). The term course used here includes all advertised courses (courses, modules, seminars). The coaching and mentoring programs are regulated separately.

Subject to modifications

The lessons, content, class times, durations, dates and fees indicated in the schedules may be subject to change processes, some of which are beyond the sole control of the training center. Therefore, the Academy reserves the right to adjust all parameters of the courses accordingly at any time. The same applies to the lecturers nominated in the courses.

Registration / Training Agreement

After booking via the homepage, by mail, in case of personal booking on site or by phone, the training contract is formally concluded. Other verbal agreements to this agreement are excluded. Cancellations, terminations, changes and/or amendments must always be made in writing by e-mail (info@livingsense-executive.ch) or by postal letter. (By mail, the date of the letter postmark is valid). After the conclusion of the contract, the following deadlines and regulations apply to its dissolution

Cancellations/ Pre- and make-up a course

Students have the option of bringing forward or making up missed course days. This option is available in all courses at all locations (as well as online) as long as space is available.

Days with absences can be attended and made up in advance and afterwards.

If you wish to make up a course day, you must register for the day you wish to attend and cancel your registration for the day you do not wish to attend.

In order to make this possible for all students, the following guidelines must be noted when cancelling course days:

  • Deregistrations which are made min.14 days prior to implementation do not require proof and are free of charge.
  • Cancellations made less than 14 days before the event require a doctor’s certificate (or equivalent) or are subject to a CHF 150 fee for re-registration of the content.
  • Days not attended without cancellation cannot be made up free of charge. A new booking is subject to a fee of CHF 300 per course day.

Cancellations for course days must be submitted in writing to info@livingsense-executive.ch. Cancellations that are communicated otherwise cannot be considered.

Cancellation of a registration

Any registration within 14 days of booking is subject to the goodwill period and can be cancelled free of charge. The grace period expires 7 weekdays before the start of the course. Thereafter, the following binding regulations shall apply. In the case of telephone or verbal registrations, the date of the course confirmation is deemed to be the start of the cancellation period.

If the notice of termination
takes place 90 days before the start of the course the cancellation is free of charge.

  • between 89 – 60 days before the start of the course: 20% of the above-mentioned course fees are due
  • between 59 – 30 days before the start of the course: 60% of the above course fees are due
  • From the 29th day before the start of the course, 100% of the above-mentioned course fees are due

The respective start date of the course (1st day of training) and the corresponding semester dates can be seen in the timetables or the course confirmation. Agreed payment models shall remain in force even in the event of a chargeable termination. A course offering must be viewed holistically, as a single product. It is therefore not possible to withdraw from individual course days.

Offers that are carried out online or contain an online component are available to the customer shortly after booking and require registration. Both the goodwill period and the notice period expire in full as soon as registration and thus access to the online segment has taken place. With registration, the course is considered to have started with regard to the course fees.

Course offers where meals and/or overnight accommodation are part of the training offer (e.g. personality retreats) are fully chargeable after expiry of the grace period.

We recommend that you take out cancellation insurance with an insurance provider for your education.

Interruption of training due to illness / pregnancy / accident

The training can be interrupted in case of illness / pregnancy / accident for a period of max. 2 years. The participant can optionally repeat the course days already attended when re-entering the course.

The payment agreement for instalment models remains in force even in the event of a break in the original term. Payments already made will not be refunded for the period of interruption.

This regulation presupposes that the course attended is still available in the training programme at the time of readmission. Subject to modifications. Should the course or parts of the content no longer be held, the participant will be offered an adequate replacement.

Rebooking options

These regulations apply to all seminars, further education and study programmes with the exception of retreats and similar formats which are connected with a residential stay. For retreats of similar formats, the rule of binding a booking 100% applies to the course costs and the obligation towards the location & catering partners. In your own interest, we strongly recommend that you take out cancellation insurance.

Rebooking for a follow-up course

A rebooking with a time shift to a subsequent course with identical content is possible free of charge within a time frame of 2 years before the course begins (exception: retreats & similar formats). However, the original notice periods and payment deadlines remain on the date of the previous booking. If a rebooking is made after the start of the course to an identical course with a later date, the regulation on interruption of studies comes into force.

Rebooking to a course of comparable scope but with different content

If a participant wishes to change to another course format with a comparable scope and identical cost structure, the following regulations apply:

  • Up to 30 days before the start of the course at any time free of charge (except for retreats & similar formats) However, the original notice periods and payment deadlines remain on the date of the previous booking.
  • 30 – 1 day before the start of the course possible (exception retreats & similar formats). However, the original notice periods and payment deadlines remain on the date of the previous booking. This last-minute rebooking triggers a fee of CHF 250.

Rebooking after the start of the course is possible up to the completion of 30% of the course (exception: retreats & similar formats). The course days already attended in the previous format will be charged additionally as a percentage of the course price, unless it is a declared overlap due to a course linkage. However, the original notice periods and payment deadlines remain on the date of the previous booking.
If the newly selected course is more cost-intensive, the difference will be invoiced in addition at a later date with the payment deadlines applicable to the booking.

Additional regulation regarding a rebooking in a comparable course with lower costs.

If the newly selected course is less expensive, the client will be issued an education voucher for the difference. No payout will be made.

Data protection

Personal data is processed in accordance with our privacy policy. By registering, the course participant confirms that he/she has taken note of the data protection declaration and the processing of his/her personal data described therein.

Hygiene regulations and conditions

Participation in the course is subject to compliance with federal, cantonal or local health and safety regulations. Failure to comply with these rules, which prevents a participant from attending a course, part of a course or possible contents, is equivalent to an unexcused absence of the participant concerned. Living Sense Executive shall not be obliged to provide a replacement or repeat content in such a case. Such a situation does not denote a serious change of content on the part of Living Sense Executive.

Conducting courses

The Living Sense Executive is entitled to postpone, combine or cancel courses with an insufficient number of participants. In the event of cancellations at short notice by the Living Sense Executive, course fees already paid will be refunded or credited to other courses. The school operation and the requirements for examinations and diplomas are governed by the respective guidelines and examination regulations of the individual courses.

Terms of payment: One-off payments

The client has the choice between a one-off payment and instalment payments, which are subject to a fee.

A one-off payment is due 10 days before the course starts. For bookings made less than 10 days before the start of the course, payment is due within 10 days of booking.

Offers abroad

For courses that require travel abroad, we recommend a travel insurance. The trip itself is not organised or managed by Living Sense Executive, but is the responsibility of the participant to comply to all entry requirements and local laws. Travel to and from the course location is the responsibility of the participant.

Specific regulations may be required at these course locations to protect staff and participants, these are mandatory. Non-compliance may result in exclusion from the course and course locations.

Should a journey have to be cancelled by Living Sense Executive, an airline or by the hotel due to environmental or climatic influences or for safety reasons, Living Sense Executive accepts no liability. These possible damages must be covered by the travel insurance.

Travel, education and health insurance are compulsory for all offers abroad. The insurance has to be taken out by the participant himself/herself and the necessary documents have to be carried. For journeys abroad, we also recommend REGA membership to secure return transport.

For the services of the travel providers (hotel, transfer, seminar houses) a deposit of 20 -50% is to be paid at the time of booking, depending on the destination. Depending on the hotel’s policy, the balance must be paid before arrival or will be paid on arrival. The exact conditions for payment are mentioned on the registration confirmation. If payment has not been received in the clearing bank account, participation in the course and/or trip may be refused. In this case, 100% of the course costs will be charged.

Students are responsible for informing themselves about possible entry requirements as well as local requirements, legislation and their implementation. The decision not to enter or the prevention of entry by local authorities does not change the deregistration rules. Arrival in violation of legislation or requirements will result in the immediate expulsion of the student without entitlement to care or remuneration.

Principles Video Recording/Audio Recording

Teachers are allowed to make video recordings for use in class. The recordings must serve the fulfilment of a direct pedagogical goal, such as feedback on the learning process or for examination evaluations. Video and audio recordings are only permitted with the respective information by the teacher. No tacit recordings are made at any time. The video recordings, audio recordings or photos may be used by Living Sense Executive for training and educational purposes without any restrictions in terms of time, space, subject matter or content and free of charge.

Recording devices Video recording / Audio recording

Video recording is only allowed with Living Sense Executive equipment. The devices are to be marked accordingly in a conspicuous manner. All recordings with private devices (also by learners) are strictly prohibited.

Accident insurance

Insurance is the responsibility of the student. The Living Sense Executive disclaims all liability.

Laws and federal guidelines

In the case of regulations/legislation/mandates by the federal government, cantons and other local legislators, the conditions of participation as well as the conditions of implementation of courses, seminars and training may change. Participants are under an obligation to fulfil these requirements in order to continue attending the course, as they are within their power and responsibility. As this is not a change on the part of Living Sense Executive, but of local legislation, this does not constitute a fundamental change of offer and is not a reason for withdrawal. Living Sense Executive will always comply with and implement local as well as national legislation. Violation of legislation or non-compliance with conditions of participation based on such requirements will be considered a default on the part of the participant. Living Sense Executive is in no way obliged to provide an alternative for participants who cannot or do not wish to comply with local and national regulations and legislation.

If Living Sense Executive is prevented from running the programme by local or national regulations, Living Sense Executive can either choose an alternative form of running the programme or pause the programme until the conditions allow it to be run again.

Discounts and vouchers

Discounts, promotions, equivalence recognition and other influences on the course price can be applied directly at the time of booking and not retrospectively. These are always applied in full to the first invoice amounts. Discounts are limited in time and cannot be applied retrospectively. Vouchers have a validity of 10 years according to consumer protection regulations.
